The Dangers of Do-It-Yourself Estate Planning

Each year, many people create their own estate planning documents online rather than hiring a lawyer to do it for them. If you are thinking about bypassing legal counsel and taking this route, you may want to consider the benefits of hiring an experienced estate planning lawyer and the pitfalls of these "do-it-yourself" programs. While purchasing legal documents online may initially be less expensive than hiring a lawyer, there are substantial benefits to hiring an experienced estate planning lawyer that are not available online.

First, your lawyer will be able to answer all of your questions and help you understand the purpose of each document. Your lawyer can also advise you regarding the selection of your Personal Representative, guardian, or conservator of minor children or your agent under a power of attorney.

Second, by meeting with an estate planning lawyer, you can discuss and prepare for possible contingencies, such as the disability of a person named in your documents or an unnatural order of deaths in the family. Many estate planning documents created online do not account for certain circumstances. A lawyer can help you answer all of the important "what if" questions.

Third, an estate planning lawyer can help you understand how to minimize the need for probate of your estate and how to prevent the erosion of your estate due to estate and gift taxes.

Fourth, your lawyer can help you properly execute your estate planning documents. Arizona law has specific execution requirements that must be satisfied in order for wills and powers of attorney to be valid.

If you want to establish a will, revocable living trust, or powers of attorney, please contact Scottsdale estate planning attorney, Grant McKeehan.
